What is Crashworthiness? Our Memphis Accident Attorneys Explain.
When you buy a car, you expect it to meet certain safety standards. You expect that your car will work as intended, your seat belts will stay fastened in an accident, your airbags will deploy when needed, and the frame will protect while absorbing the impact of an accident through its crumple zones. These are reasonable expectations, and it is reasonable to expect your vehicle to prevent or lessen the severity of injuries during a Memphis car crash. The legal term for this concept is crashworthiness.
You may remember the Toyota recalls in 2009 and 2010. More than 9.3 million vehicles were recalled because the cars might cause sudden unintended acceleration due to floor mat or accelerator problems. The defects were blamed for more than 1,000 accidents and several deaths. Toyota agreed to pay more than one billion dollars to settle a class action lawsuit related to the recalls.
In 2012, 13.4 million vehicles were recalled. These included vehicles made by Toyota, Honda, General Motors, Ford and Chrysler. Each of these vehicles was recalled because a manufacturer defect made them unsafe.
Vehicle manufacturers are responsible for making sure they are selling a safe product. If a vehicle defect contributed to your Tennessee auto accident, you may be able to file a Tennessee crashworthiness claim against the manufacturer of your vehicle. To discuss a potential crashworthiness lawsuit, please contact the Memphis auto accident attorneys at Bailey and Greer at 877-819-4414.
