Determining Trucking Company Negligence
Trucking accidents cause serious injuries and fatalities on the Tennessee roadways. While the operators of these vehicles are often blamed for the crashes they cause, trucking companies often have some responsibility as well. This especially applies to instances where negligent hiring practices or improper vehicle maintenance led to the crash. When victims of these truck crashes seek compensation for their injuries, they may find it necessary to include the trucking company in their claim.
Service hour violations can lead to fatigued driving
The state of Tennessee places restrictions on the amount of time that truck drivers are allowed to operate these large vehicles on the roadway. To enforce these rules, most drivers are required to keep logs and consistently track the number of hours they have spent on the road. For example, truck operators are reportedly prohibited from driving after having worked 60 hours in any seven consecutive days, or after having worked 70 hours in any period of eight consecutive days.
Unfortunately, trucking companies often fail to enforce these regulations. Instead, they allow, or even encourage, their operators to drive excessively. This leads to distracted and fatigued drivers on the road, which is a leading cause of serious trucking accidents.
Negligent hiring practice places everyone on the road at risk
Trucking companies are responsible for hiring experienced and competent operators to drive their trucks. Adequate hiring practices should include:
- Driving history record checks to ensure a history of safe driving behaviors.
- Pre-employment alcohol and drug screening to ensure that the driver is not under the influence of any substance. This type of screening should also take place throughout the driver’s employment.
- Checking for adequate certification and driving privileges relevant to the type of truck being operated.
When trucking companies fail to implement these safety measures, they risk putting dangerous drivers on the roadways in extremely heavy and large vehicles.
Trucking companies have an obligation to properly maintain their trucks
Trucking companies are also obligated to maintain their trucks in accordance with state regulations. As explained by the Tennessee Farm Bureau Association, all vehicles over 10,001 lbs. involved in interstate commerce must be inspected each year by a certified mechanic. Properly inspected items should include braking systems, fuel systems, lights, steering, suspension, tires, windshields, and wipers. Even when not due for inspection, trucking companies must maintain their vehicles and properly respond to mechanical issues in a timely manner.
