A Closer Look at Wrongful Death in Memphis, Tennessee

We all probably know about, or have been connected somehow, to a loss of life situation that we believed at the time was unfair or preventable. Maybe you have personally witnessed or been in a situation that you “knew” should have been investigated more carefully, but felt stranded and defenseless, not knowing what to do or who could help you figure it out.

Over my twenty-five plus year career, I’ve had the opportunity and privilege to help dozens of people who have lost loved ones to wrongful death. I’ve seen young families torn apart following the death of a husband and father in an auto accident. I’ve worked with parents distraught over a child’s death following the misdiagnosis of a medical condition. I’ve helped the children of elderly citizens who died in nursing homes following a preventable fall or the development of bed sores.

Losing a loved one is always difficult, no matter the circumstances, but the loss can be truly devastating when the death was unexpected, preventable, and caused by someone else’s negligence.  It’s terrible to think that while a person should be grieving over the death of a parent, spouse, child or other family member, that they must also be concerned with navigating their way through the legal system. That’s where we come in.  Helping the families of wrongful death victims is what we do every day at Bailey & Greer.

Often times there are misconceptions about exactly what constitutes a wrongful death claim. Sometimes these questions are easy to answer, for instance when a person lawfully stops at a red light and is rear-ended and killed by a drunk driver. Other times, it can be more difficult to determine whether a claim for wrongful death exists.
