How Do I Know if I Have a Medical Malpractice Case?
That’s a difficult question because we’re lay people. We don’t have medical backgrounds; we don’t know. I would suggest to you that the first focus should be, “How badly am I injured?” Because if you’re not badly injured, then it really doesn’t matter whether you have a malpractice case or not.
Let me tell you what I mean.
We have, at Bailey & Greer, we have a nurse on our staff who evaluates medical malpractice cases. We keep up with this and I can tell you that my firm takes about one out of every 300 medical malpractice cases that we look at.
And why is that?
It’s because these cases are difficult, they’re expensive, and we take very seriously our obligations. We don’t want to sue a doctor unless he really ought to be sued. These cases have got to be strong cases with very serious injuries. That’s what’s required.
So, instead of trying to figure out whether or not there might be some medical breach, whether or not the doctor did something medically, question one should be, “Am I really, really seriously hurt?” And if the answer to that is “no,” then I suggest to you that you probably do not have a case that anybody, any competent medical malpractice lawyer, is going to be interested in handling.
