Negligent Trucking Companies: Truck Driver Log Book Fraud
In a lot of our truck wreck cases, we uncover log book fraud. What that means is, there is a federal motor carrier safety act that requires truckers to keep log books of their hours. They’re only allowed to drive so many hours per day. They’re only allowed to drive so many hours per week, and they have to take mandatory rest breaks and things like that in between.
Just like anything in life, there are people who will cut corners in the trucking industry for all sorts of reasons. A lot of times when we get involved in cases, we request the log book and then we request all kinds of other information to verify whether or not the book has been fraudulently kept. We’ll collect fuel receipts to match up whether the driver filled up for gas in a city where his log books indicate he should’ve been nowhere near. We’ll pull GPS records to track the trucks. We’ll do all kinds of things to try to find whether the trucker has violated the log books. Because what it reveals is if the log books have violated, then that truck driver should not have been out on the road. He’s been driving too long. He’s fatigued. He’s tired. It can be a real difference maker in a case, especially if the facts are close or are disputed.
