Connecticut Bicycle Accident Reminds Memphians of Dangers Cyclists Face
As more Memphians embrace bicycling, a Connecticut family’s tragedy reminds us of the ever present danger bicyclists face.
Jose Campos, was riding his bicycle in September 2008 when he was hit by a van owned by the hotel corporation LaQuinta Inn and Suites. Campos was not wearing a helmet and suffered a serious head injury as a result of the accident. After three days of surgeries, Campos eventually died from his injuries.
At trial, it was unclear whether Campos obeyed traffic laws while riding his bicycle. However, it was established that the van driver was traveling 40 mph in a 25 mph zone and was using his cell phone at the time of the accident.
Although the jury found that both parties were at fault for Campos’ injuries and death, they found the defendants to be 58% at fault and Campos to only be 42% at fault. This resulted in the jury awarding Campos’ estate and widow $2.3 million; $1,709,840 in damages to Campos’ estate and $580,000 to Campos’ widow.
